目的港費用糾紛爭議,海上貨物運輸環節項下的爭議之一,古老而略帶神秘色彩,一直以來頻繁困擾貨運代理人、承運人。甚至對于一些常見的、知名船東而言,此類爭議頻繁發生,對于標的不大的案件,通常采取留置貨物措施或在商業合作層面解決;對于標的較大的案件,通常循法律途徑解決。

DestinationFees Dispute, one of the most commonly seen disputes concerning carriage ofgoods by sea, ancient and slightly mysterious, has been a confusing and vexingproblem for many carriers and agents for a long time. Even for some famous ship-owners,Destination Fees Dispute occurs constantly. For small cases, ship-owners oftenseek settlement by detaining the goods involved or through amicable negotiationout of concern for future cooperation; but for some big cases, ship-owners areusually compelled to resort to litigation.

1、被告的識別、選擇:

被告的識別、選擇,其實主要是法律關系的選擇,不同的法律關系,證據的挖掘、審查也不同。

The identification of the proper defendant is inessence a choice of legal relationship. Different legal relationships decidedifferent requirements in terms of evidence.

2、義務的履行

(Performance of obligations)

過錯方證據的收集工作尤為重要。作為貨運代理人也好,作為承運人也罷,每票貨物運抵目的港前,必須履行告知委托人(托運人)目的港費用產生的事由、依據以及船公司、碼頭的收費標準,同時督促委托人(托運人)及時通知收貨人提取貨物。

Collecting evidence is extremely important. When a shipmentarrives at the discharging port, the cargo forward agent, as well as thecarrier, must advice the shipper of the cause and basis of the destination feesas well as the ship-owner & terminal’s charge standards, and furthermore urgethe shipper to notify the consignee to collect the cargos timely.

3、集裝箱超期使用費

(Detention Fee)

根據現有判例,集裝箱超期使用費以重新購置一個同類規格集裝箱的價值為限;

According to the recent Judgments, the DetentionFee per container should not exceed the cost of buying a new container of thesame kind.

4、堆存費(艙租)

(Demurrage)

考慮到這部分費用的收費主體,現在法院對此審查較為嚴苛,考察哪一方是收費主體,收費主體有無權限收取該部分費用,對此舉證難度較大;

In view of the charging party of such kind of feeand the rigorous assessment of the court in this respect, it is often difficultto discharge the burden of proving the charging party and whether or not thisparty is entitled to collect the demurrage.

5、費用實際支付情況

(Actual payment)

國內貨運代理公司通常在與境外的代理公司(目的港的貨運代理人)存在合作關系,目的港費用通常是雙方按月結費用時一并結算,這就造成了證明國內貨運代理公司在證明其實際支付目的港費用時存在困難;同樣地,船公司在與目的港碼頭公司結算時存在同樣的問題。

It is common practice that domestic agents are incooperation with agents aboard (destination forward agents) and thatdestination fees are settled along with other fees between both parties on a monthlybasis, which can cause some difficulties in proving that the agent has actuallypaid the destination fees. Likewise, the ship-owner is likely to have the sameproblem when settling the money with the terminal company.
